STARTUP HAWAII LLC (“Startup Hawaii,” “we,” “our,” or “us”) respects the privacy of our website visitors. The following privacy notice (“Privacy Notice”) informs you of the types of information we may collect from you (“you,” “visitor,” or “users”) or that you provide to us when you visit and engage with our website www.startup-hawaii.com as well as any other site we own or control  (collectively, our “Sites”).

We are a private company, established in the United States, registered at 68-1858 Malina Place, Waikoloa, HI 96738 United States (“Physical Notice Address”) with the contact email address info@startup-hawaii.com (“Email Notice Address”) and for the purposes of the General Data Protection Regulation (“GDPR”) we are the data controller.

In addition, please review our Terms of Use (“Terms”) which governs your use of the Sites. By using the Sites, you acknowledge that you have read and understood our Privacy Notice and our Terms and accept our collection, use and disclosure of your information and data, and other activities, as described below. If you do not agree to the terms of this Privacy Notice, please do not use the Sites.

Note, this Privacy Notice is exclusive to our Sites and explains Startup Hawaiiʻs privacy practices regarding how and for what purpose(s) we use and disclose information we collect when you visit and engage with our Sites. This Privacy Notice does not apply to information we may collect through any other means, including engaging with you offline.

We retain the right to amend this Privacy Notice at any time and encourage you to review it whenever you visit our Sites to ensure you remain informed of our privacy practices. Changes will be reflected by an updated effective date above.

Information we may collect may personally identify you, it may be about you but not personally identifying, or it may be about your internet connection, your device and your activities on our Sites, including:

We use cookies to make interactions with our Sites easy and meaningful. When you visit our Sites, our servers may send a cookie to your computer. We use cookies that enable you to navigate our Sites and use its features, such as accessing secure areas of our Sites. We may use cookies that are session-based or persistent. Session-based cookies exist only during one session and disappear when you close your browser or turn off your computer.   • Web Beacons and Similar Tracking Technologies

Web beacons are clear graphic image used on website pages and in email to unobtrusively permit noting a user has accessed content and keep track of users’ navigation through a website or a series of websites. When you visit our Sites, we may collect your IP address for certain purposes such as, for example, to monitor the regions from which you navigate our Sites. We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Sites and your interaction with our emails. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, and when you viewed a particular website tied to the web beacon.   • A Note About “Do Not Track” Signals

We do not currently respond or take any action with respect to web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choices regarding the collection of information about their online activities over time and across websites or online services.

With respect to “Do Not Track” signals and disclosures in California, various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g., browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

 3. HOW WE USE YOUR INFORMATION

We use the information we collect through our Sites to:

  • Provide you with information, products, or services you request or that may be of interest

  • Fulfill any purpose for which you provide your information or otherwise specify

  • Notify you about products and services and/or your orders

  • Process and track your orders and transactions

  • Identify and authenticate you for access to your account and service your account

  • Carry out our obligations and enforce our rights arising out of contracts we have entered, including, but not limited to, any contracts between you and us

  • Provide you with customer services, including to respond to your inquiries or requests

  • Send you newsletters, notifications, advertisements, and promotional communications (if you do not wish to receive these communications you may click the “unsubscribe” link at the footer of our emails or follow instructions included in the communication; note, you may not opt-out of certain administrative communications)

  • Provide, analyze, administer, improve, protect, and personalize our Sites

  • Protect our rights or property and ensure the technical functionality and security of our Sites

  • Comply with applicable law, respond to regulatory or other legal inquiries, and assist law enforcement

  • Conduct research, analysis, and business development, including to develop and improve the functionality of our Sites, and our products and services

4. HOW AND WITH WHOM WE SHARE YOUR INFORMATION.

  • With Third-Party Providers.

We share information with third-party providers we engage to assist us with processing and fulfilling your order(s) and administering our Sites to ensure the highest quality user experience. We may also use third-party providers for hosting, security, technical and customer support, application development, tracking and reporting functions, quality assurance, and other services.

  • Advertising and Marketing.

We use Google AdWords for assistance providing you with relevant content and interest-based advertising. This service may collect information from your use of our Sites over time and that information may be combined with information collected about you across different websites and online services.

Some third-party advertisers participate in the Network Advertising Initiative and/or the Digital Advertising Alliance, which allows website visitors to opt-out of ad targeting from participating organizations. Opting out of receiving interest-based advertising does not mean you will no longer see advertisements from Startup Hawaii. As a reminder, you may unsubscribe from receiving email updates, alerts, newsletters and communications sent to you by email, by going to the “Unsubscribe” link at the footer of each email communication.

  • Aggregated or Deidentified Information.

We may aggregate and/or de-identify information we collect through our Sites.  Aggregated or de-identified information does not personally identify a user and is not considered personal information under applicable law. We may use and share aggregated or de-identified information without restriction.

  • In the Event of Merger, Sale, or Change of Control.

We may transfer or assign this Privacy Notice and any information we have collected about you pursuant to it to a third-party entity that acquires or is merged with us, or as part of the evaluation of or an entry into such transactions, or in the course of a merger, acquisition, sale, or other change of control, for example, as a result of a bankruptcy proceeding.

  • With Your Consent.

We may also share your information at your request or direction or when you otherwise provide your consent.

  • Other Disclosures.

We may disclose information about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) detect, prevent, or otherwise address fraud or security issues; or (iii) protect against harm to the rights, property or safety of Startup Hawaii, our users, or the public

5. INFORMATION MINIMIZATION AND RETENTION.

We collect only the amount of information necessary for the purpose(s) for which it has been collected on our Sites and retain information only for as long it is needed to fulfill the purpose(s) for which it was collected or to comply with applicable law. We retain information you provide to us on our Sites for the period to which you have agreed, including indefinitely.

6. INFORMATION SECURITY.

We take the protection of your information seriously and have implemented and maintain commercially reasonable physical, administrative, and technical measures appropriate to the nature of the information in order to protect the integrity, confidentiality and availability of the information we collect through our Sites.  Startup Hawaii cannot guarantee the complete security of your information, as the Internet is not one-hundred percent secure. provide information at your own risk.

7. CHILDREN’S INFORMATION.

Our Sites is not intended for, nor do we knowingly collect information from, individuals under the age of 18. By providing information to us on this Sites, you represent you are sixteen (16) years of age or older. If we become aware of having collected information from a Sites visitor under 16, we will delete the information immediately.  

 8. LINKS TO OTHER WEBSITES.

OUR SITES MAY INCLUDE LINKS TO OTHER THIRD-PARTY WEBSITES, AS A CONVENIENCE TO YOU. This Privacy Notice does not apply to those third-party websites. The inclusion of any link does not imply Startup Hawaii’s endorsement of any other company, its website(s), or its product(s) and/or service(s).  IF YOU CLICK ON A PROVIDED LINK, YOU WILL BE TAKEN TO WEBSITE OVER WHICH WE HAVE NO CONTROL, AND WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR CONTENT OF ANY OTHER WEBSITE.

9. SOCIAL MEDIA AND PLUG-INS.

We may offer social media plug-ins (e.g., the Facebook "Like" button, "Share to Twitter" button) on our Sites for your convenience and to enable you to easily interact with certain social media websites (e.g., Facebook, Twitter, Instagram) and share information with others.  When you visit our Sites, the operators of the available social media plugins can place a cookie on your device enabling such operators to recognize individuals who have previously visited our Sites.  If you are logged into these social media websites while visiting our Sites, the social media plugins allow the relevant social media websites to receive information that you have visited our Sites.  Social media plugins also allow applicable social media websites to share information about your activities on our Sites with other users of the social media website.  For example, Facebook Social Plugins allow Facebook to show your "Likes" and comments on our online Sites to your Facebook friends.  Similarly, Facebook Social Plugins also allow you to see your Facebook friends' Facebook activity on our Sites.  We do not control any of the content from any social media plugins.

We may also interact with you on social media platforms. If you contact us or otherwise communicate with us on social media, we may communicate in response and/or contact you to interact with you. 10. CALIFORNIA RESIDENTS; NEVADA RESIDENTS.

PRIVACY NOTICE

California Specific Privacy Rights. This section applies with respect to any users located in the State of California. For California residents, pursuant to the California Consumer Privacy Act of 2018, as amended (“Consumer Privacy Act”), you may (i) elect to opt out of the sale of your “personal information” (as defined by the Consumer Privacy Act) by Company, (ii) request that Company and its service providers delete any of your personal information collected, (iii) request that Company deliver to you, free of charge, any of your personal information collected over the past 12 months preceding the request, and (iv) request certain information regarding any collection, sale, and disclosure of your personal information over the past 12 months preceding the request (including the categories of personal information collected, sold, and/or disclosed for a business purpose, the categories of sources from which the information was collected, the business or commercial purpose for collecting or selling the information, the categories of third parties with whom the information was shared, and the specific pieces of the information collected).

You must include your full name, email address, and postal address in your request.

Company will honor these rights to the extent required by the Consumer Privacy Act. Any requests submitted must be verified by us before we will respond, and to enable this verification we may require you to provide us information confirming your identity, which may include any username or password information, and the personal information matching that which we have in our records. You may submit requests through an authorized agent given authority through a power of attorney form or other authorization acceptable to and verified by us. Company will not discriminate against users based on their exercise of any of the rights under the Consumer Privacy Act, provided that Company may charge different prices to users based on the value of the data they provide.

The types of personal information collected in the last 12 months and how this information has been shared are as described in this Privacy Notice.

In addition, you are a California resident, you have the right not to receive discriminatory treatment by us for the exercise of your rights conferred by the CCPA.

Nevada Privacy Rights – “Do Not Sell My Personal Information”.  We may elect to share information about you with third-parties for those third-parties’ direct marketing purposes. Nevada Revised Statutes §§ 603A.300-.360 permits Nevada residents who have supplied personal information (as defined in the law) to us to, under certain circumstances, request and opt out of the sale of your personal information to third parties for their direct marketing purposes. If this law applies to you, and you wish to make such a request, please provide sufficient information for us to determine if this applies to you, attest to the fact that you are a Nevada resident and provide a current Nevada address for our response. To make such a request, please contact us at our Email Notice Address with “Nevada Privacy Rights” as the subject line or mail us a letter at our Physical Notice Address. You must include your full name, email address, and postal address in your request.

11. STANDARD CONTRACTUAL CLAUSES

To the extent Startup Hawaii has agreements in place with any affiliates or subprocessors, each who may have access to the personal data, such agreements shall incorporate the EU Commission approved Standard Contractual Clauses (“Standard Contractual Clauses”).

12. DATA TRANSFERS

Onward Transfer. Startup Hawaii will not disclose any personally identifiable information to a third party who is not a Startup Hawaii contractor or agent (“Agent”) except as outlined above. For third parties acting as an Agent, Startup Hawaii will ascertain that the third party follows the Standard Contractual Clauses, is subject to the EU Data Protection Directive, or has entered into an agreement with Startup Hawaii that is consistent with the applicable or required principles.

In the context of an onward transfer, Startup Hawaii has responsibility for the processing of personal information it receives under the Standard Contractual Clauses and subsequently transfers to an Agent on its behalf. Startup Hawaii shall remain liable under the Standard Contractual Clauses if its Agent processes such personal information in a manner inconsistent with such principles, unless Startup Hawaii proves that it is not responsible for the event giving rise to the damage.

Data transfer to other controllers. Principally, your any personally identifiable information is forwarded to other controllers only if required for the fulfillment of a contractual obligation, or if we ourselves, or a third party, have a legitimate interest in the data transfer, or if you have given your consent. Additionally, data may be transferred to other controllers when we are obliged to do so due to statutory regulations or enforceable administrative or judicial orders

Service providers (general). We involve external service providers with tasks such as sales and marketing services, contract management, payment handling, programming, data hosting, and hotline services. We have chosen those service providers carefully and monitor them on a regular basis, especially regarding their diligent handling of and protection of the data that they store. All service providers are obliged to maintain confidentiality and to comply with the statutory provisions. Service providers may also be our affiliates.

13. INTERNATIONAL TRANSFERS.

Startup Hawaii is based in the United States, as are its servers. If you are accessing our Sites from outside the United States, be advised that your information may be transferred to and stored and processed in the United States the laws of which may not provide the same level of data protection as those in your jurisdiction.
